The terms “we”, “us”, and “our” refer to Natura Illustraa - Anastasiia Morozova (“Company”). The term “Site(s)” refers to www.anastasiiamorozova.com and any related subdomains (“Sites”).
On these Sites, we provide information, products, and services related to drawing, painting, branding, and marketing for artists and creatives, including but not limited to the "Make Art with Confidence" program and self-learning versions of the course without mentorship (collectively, “Services”).
The terms “user,” “customer,” “you,” and “your” refer to visitors, users, and customers of the Sites and/or Services. By using our Sites and/or Services, whether available for purchase or not, you are agreeing to these Terms of Service, our Privacy Policy, and any other agreements that govern your use of our Sites or Services (collectively, “Agreements”). You should not use our Sites or Services if you do not agree with the terms and conditions contained in these Agreements.
1. Use of the sites and services
To access or use the Sites and/or Services, you must be eighteen (18) years or older and have the requisite power and authority to enter into these Terms of Service. Minors are prohibited from using the Sites and/or Services.
2. Lawful purposes
You may use the Sites and/or Services for lawful purposes only. You agree to be financially responsible for all purchases made by you. You agree to use the Sites and/or Services and to purchase our Services for legitimate purposes only. You shall not post or transmit through the Sites and/or Services any material which violates or infringes the rights of others, or which is threatening, abusive, defamatory, libelous, invasive of privacy or publicity rights, vulgar, obscene, profane or otherwise objectionable, contains injurious formulas, recipes, or instructions, which encourages conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any law.
3. Account creation
In order to use the Sites and/or Services, you may be required to provide information about yourself including your name, email address, username, password, and/or other personal information. You agree that any account information you provide on the Sites or to the Company will always be accurate, correct, and up to date. You must not impersonate someone else or provide account information or an email address other than your own.
4. Consent
When you register with the Company (for example, by creating an account, registering to receive emails, or by purchasing our Services), you expressly consent to receive any notices, announcements, agreements, disclosures, reports, documents, communications concerning new products or services, or other records or correspondence from the Company and you consent to receive notices electronically by way of transmitting the notice to you by email. 5. Refusal of services
We reserve the right to refuse access to the Sites and/or Services to any person or entity, without the obligation to assign a reason for doing so. We reserve the right to immediately remove you from the Sites and/or Services, without refund (if applicable) or liability, if you violate these Terms of Services or other Agreements governing your use of the Sites and/or Services.
6. Cancellation policy
Since our digital products and courses are purchased as one-time payments or through installments, cancellations are not applicable once a purchase has been completed. All sales are final, and refunds are not available once the product has been accessed or downloaded. If you encounter any issues with your purchase or payment plan, please reach out to our support team, and we will assist you as best as we can.
7. Customer feedback
You agree that the Company has the right to use your feedback for marketing or promotional purposes.
8. Release
You agree that the Company may use any images, audio recordings, or video recordings of you obtained while using the Services. You waive any right to payment, royalties, or any other consideration for the use of such media.
9. No confidentiality
Given the group format of the "Make Art with Confidence" course, especially in the mentorship program where active interaction between students is encouraged, any information shared with the Company or other participants is not considered confidential. While we strive to maintain a respectful and supportive environment, and expect all participants to respect each other's privacy and personal information, please be aware that discussions, feedback, and shared content within the group setting are accessible to all members. We encourage open sharing, but advise against disclosing sensitive or personal information that you wish to keep private.
10. Participant’s conduct
You agree to conduct yourself in a professional manner. The Company reserves the right to remove you from the Services without refund if your behavior is disruptive.
11. Live events
Any costs associated with attending live events are your sole responsibility.
12. No guarantees of results
The Company does not guarantee any specific results from using the Sites and/or Services.
13. Disclaimer
Your use of the Sites and Services is at your own risk. The Services are provided "as is" without warranties of any kind. The Company disclaims all warranties.
14. Lifetime access
"Lifetime access" refers to the lifetime of the Service. If the Company decides to retire any product for any reason, your access will terminate without refund or liability.
15. Intellectual property
The Sites and/or Services, including all digital products, static and moving images, educational content, learning processes, designs, graphics, videos, and any other related intellectual property, are the exclusive property of the Company and are protected under Italian and international copyright, trademark, and intellectual property laws. You are prohibited from modifying, publishing, transmitting, participating in the transfer or sale of, creating derivative works from, distributing, displaying, reproducing, or performing any of the Sites and/or Services without prior written consent from the Company. Any unauthorized use of our digital content may constitute a violation of copyright laws under Law No. 633/1941 (Legge sul Diritto d'Autore) and trademark laws under the Italian Industrial Property Code (Codice della ProprietĂ Industriale), established by Legislative Decree No. 30/2005, both of which are consistent with international agreements, including the Berne Convention for the Protection of Literary and Artistic Works and the Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS). Violations of these rights, including but not limited to unauthorized reproduction, distribution, or public performance of our digital products or educational content, will result in legal action, which may include claims for damages, injunctive relief, and recovery of legal costs. The Company is committed to enforcing its intellectual property rights to the fullest extent permitted by law.
16. Limitation of liability
To the extent permitted by law, the Company will not be liable for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including loss of revenue or income, loss of data, pain and suffering, emotional distress, or similar damages.
17. Third-party websites and resources
The Sites and Services may contain links to third-party websites. The Company is not responsible for the availability, accuracy, content, or policies of third-party websites.
18. Affiliate links
From time to time, the Company may include affiliate links. The Company may earn a commission if you purchase an item using an affiliate link.
19. Indemnification
You agree to indemnify and hold us harmless from any and all losses, damages, settlements, liabilities, costs, charges, assessments, and expenses arising out of any breach by you of these Terms of Service.
20. Governing law
These Terms of Service shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law principles. Any disputes arising out of or relating to these Terms, the Sites, or the Services shall be subject to the exclusive jurisdiction of the courts located in Lecce, Italy, which shall be the competent forum for resolving such disputes. By using our Sites and Services, you agree to submit to the personal jurisdiction of the courts in Lecce and waive any objections related to jurisdiction, venue, or forum non conveniens. This clause does not limit any rights you may have under applicable European Union regulations, including but not limited to Regulation (EU) No 1215/2012 on jurisdiction and the recognition and enforcement of judgments in civil and commercial matters (Brussels I Recast), which may grant you different procedural rights or forums under specific circumstances. For consumers residing in the European Union, nothing in these Terms shall limit any mandatory rights granted by applicable EU consumer protection laws. Such laws may provide additional protections or rights, and we respect and comply with these legal requirements.
21. Dispute resolution
Any disputes arising out of or relating to these Terms of Service, the Sites, or the Services shall first be addressed through mediation. The mediation process may be conducted remotely or in a mutually agreed-upon location that is convenient for both parties. If mediation does not resolve the dispute to the satisfaction of both parties, the matter may then be escalated to litigation. In such cases, the dispute shall be subject to the exclusive jurisdiction of the courts located in Lecce, Italy. Both parties agree to make a good-faith effort to resolve disputes through mediation before pursuing legal action. This process does not preclude either party from seeking interim or emergency relief in a court of competent jurisdiction if necessary to protect its rights or interests.
22. Entire agreement
These Agreements constitute the entire agreement between you and the Company with respect to the Sites and/or Services.
23. Waiver
The Company's waiver of any provision of these Terms of Service shall not be deemed a waiver of any other provision, nor a continuing waiver.
24. Severability
If any term is held to be invalid, the remaining terms shall remain in full force and effect.
